MOJ Issued Notice on Seeking Public Comments on Revised Arbitration Law

On July 30, 2021, Ministry of Justice of the People’s Republic of China drafted the Arbitration Law of the People’s Republic of China (Draft Revision for Comment) (the “Draft Revision”) and issued the same for public comments. The deadline for submitting comments is August 29, 2021. The Explanatory Notes to the Draft Revision was issued on the same day.
There are 99 articles in the Draft Revision, 19 more than the current Arbitration Law of the People’s Republic of China. The revisions mainly cover the following aspects: general principles of the law, arbitration institutions, arbitrators and the Arbitration Association of the PRC; arbitration agreements; arbitration procedure; cancellation of an arbitration award; enforcement of an arbitration award and foreign arbitration, etc.
