Beijing Foreign Investment Regulations (Draft for Comments) Released

On September 20, 2023, Beijing Municipal Commerce Bureau published an announcement on soliciting public comments on the Beijing Foreign Investment Regulations (Draft for Comments) (the “Regulations”), with a deadline of October 19, 2023 for comments. The Regulations are drafted in accordance with the PRC Foreign Investment Law, the Implementing Regulations for PRC Foreign Investment Law and other applicable laws and regulations and for the purposes of promoting Beijing foreign investment, regulating foreign investment management, protecting legitimate rights and interests of foreign investors and advancing high-quality development of Beijing open economy.
The Regulations consist of 9 chapters on general provisions, investment admission, investment promotion, investment protection, investment management, investment facilitation, investment service, legal responsibilities and supplementary provisions, totaling 44 articles. The Regulations highlights that all the policies of the State and Beijing in support of enterprise development shall be applicable legally and equally to foreign-invested enterprises, specifies the areas and type of enterprises that Beijing encourages and guides foreign investors to invest in, and emphasizes that it is necessary to establish and improve a diversified foreign investment promotion system, strengthen coordination of Beijing investment attraction and linkage of urban areas, and expand overseas investment attraction channels.
