AllBright Client Wins Trade Secret Case
2013-06-2110833On June 17, the Shanghai No. 2 Intermediate People’s Court ruled that Sino Legend (Zhangjiagang) Chemical Co. Ltd, advised by AllBright, won the SI Group Inc and SI-Group (Shanghai) vs. Sino Legend (Zhangjiagang) Chemical Co. Ltd trade secret infringement and patent application case.
Plaintiff SI Group and SI-Group (Shanghai) claimed that defendant Sino Legend infringed SI Group’s trade secret and patent application rights with its tire resin production techniques and requested substantial damages. The case lasted for three years. The Shanghai No.2 Intermediate People’s Court ruled that the plaintiff’s claims hold no factual or legal basis because the defendant’s technique was self-developed without violating the plaintiff’s trade secret or patent application right. Thus, the court rejected SI Group’s claims and ruled SI Group to undertake all the costs and expenses arising from the case.
